The article refers to one of the prerequisites for a criminal record when filing a claim in a civil case – a claim at the location of the defendant. When preparing and filing statements of claim to the court, the issues of judicial review of the dispute remain relevant.

Persons who have filed a claim in accordance with the Civil Procedure Code of the Republic of Kazakhstan, claims against an individual are brought to court at his place of residence, and a legal entity - at his place of residence. In addition, procedural law separately defines contractual jurisdiction, i.e., in accordance with procedural law, the parties have the right to determine the territorial jurisdiction of the case in writing. Thus, the legislator grants the parties the right to establish contractual territorial jurisdiction under this rule, except for exclusive jurisdiction under the requirements provided for by law.

At the location of the defendant, the procedure and requirements of the claim are set out, further measures are proposed to protect the rights of the plaintiff.
