LABOR SPECIALIZED COURT AS A TYPE OF COURT FOR RESOLVING LABOR DISPUTE

Abstract

The article highlighted the problem of the formation of specialized labor courts in Kazakhstan, in particular, the need to create a permanent labor court as a specialized body for labor cases as part of the reform of the judicial system in the Republic of Kazakhstan, the concept of which was discussed and continues to be discussed in the science of labor law. Significant changes taking place in the field of judicial settlement of labor disputes set the task of theoretical understanding of the introduction of a specialized labor judicial system at the current stage, understanding the concept of resolving labor disputes and conflicts as the most significant form of settlement of labor relations.

The purpose of the study is determined by the need to improve the judicial system of the Republic of Kazakhstan, a comprehensive study of the problems and legal foundations for the introduction and creation of specialized labor courts during the reform of the judicial system in modern Kazakhstan, the formulation of proposals for improving legislation in this area.

The methodological basis of the study is general scientific methods of cognition: analysis, synthesis, generalization, as well as general scientific, private scientific and special methods. In particular, the formal-legal method was used in the design of general theoretical definitions of the study, their features and content. The structural and functional method was used to analyze the activities of judicial authorities and their interaction with each other and institutions performing quasi- judicial functions.
