A motive is a stimulus, a source of human activity. The goal is his idea of the result of his activity or the ideal result.
They are inherent in any human activity, including harmful to society. Any intentional crime is committed for any motive and for one purpose or another [1]. But the criminal motive is not always a mandatory sign of the subjective side of the crime. Given the significance of the motive in the composition of the crime, it is obvious that the solution of issues arising during the qualification of a crime in judicial practice requires special study as an urgent issue.
The authors' article is intended to determine the place, the essence of the motive of the crime as part of the crime, as well as the criteria that must be met when qualifying a crime.
