Against the background of the development of global trends in the humanization of criminal policy, the issue of using alternative measures of criminal influence to imprisonment has become especially important for the Republic of Kazakhstan.
The study is based on a retrospective analysis of the international legal regulation of the institute of alternatives to imprisonment. This paper provides an overview and analysis of legal trends at the international and regional levels related to the implementation of the provisions of international legal acts into national legislation. The study presents an examination of the available evidence of the effectiveness of alternatives to imprisonment. The use of alternative punishment measures such as probation, community service, and electronic monitoring have a positive effect on reducing the rate of recidivism compared to traditional imprisonment. The use of alternatives to imprisonment is an effective strategy for reforming the criminal justice system aimed at humanizing punishment, improving the rehabilitation of convicts and ensuring public safety.
