In this article, the author considers that in accordance with Articles 16 and 17 of the Constitution of the Republic of Kazakhstan, everyone has the right to freedom and personal inviolability, its observance and safety by the court. Of interest are the criminal procedural measures to ensure the freedom and inviolability of the person, as well as guarantees against illegal and unjustified restrictions on this right and judicial practice in the Republic of Kazakhstan aimed at ensuring this right. In accordance with the
rights in question (suspect, accused, victim, witness, etc.). Freedoms and inviolability of the person are limited only by the procedures provided for by the criminal procedural legislation, as well as the subjects of legislation specified in it.
In addition, the relevant provisions regarding the requirements of the main provisions of the Criminal Procedure Code of the Republic of Kazakhstan are being studied.
