Abstract

Currently, citizens of the Republic of Kazakhstan have the opportunity to resolve disputes without bringing them to court. On August 5, 2011, a special law "On Mediation" was adopted and came into force. As for the mediation agreement, in Kazakhstan it is called an agreement on the settlement of disputes and conflicts, and it acquires the status of a transaction from the moment the parties sign the dispute settlement agreement. In addition, if one of the parties voluntarily failed to comply with this Agreement, the other has the right to submit an application for its application in a simplified form. The article describes the emergence and development of the mediation institute, the scope of its application, the type of intermediaries in comparison with the countries of Central Asia and the Commonwealth of Independent States.
