Abstract

       Gambling business belongs to the sphere of entrepreneurial activity, in this connection the rules of its realisation are regulated by the norms of entrepreneurial law. Along with this, there is a high level of crime associated with the illegal organisation and conduct of gambling. This circumstance is assessed not only as a factor accompanying the mercenary intentions of criminals, but also as a factor acting as a consequence in the form of the emergence of gambling addiction, as well as an accelerator of the spread of the latter. Legislative measures, acts of executive authorities, effective at the initial stages, lose their significance with the lapse of time in the sense that people who have fallen into gambling addiction find new ways to satisfy their passion for gambling, and in this they are indulged by the organisers and implementers of shadow gambling business. As a result, there is an increase not only in the number of addicts, but also in the volume of such predicate and high-risk crimes as fraud, corruption, tax offences and administrative offences.

            In the presented work the problems of harmonisation of legal policy in the field of gambling business, counteraction to negative consequences that require criminal or administrative-legal impact on the subjects of relations formed in connection with gambling addiction are investigated.
